Abstract

We analyze the right of access to justice of persons with disabilities in the earing act of the Civil Procedure of La Rioja. The aim of this study is to systematize the procedural bases for the access of justice of persons with disabilities on an equal basis with others, including through the provision of procedural and age-appropriate accommodations, in order to facilitate their effective role as direct and indirect participants, including as witnesses, in all legal proceedings of La Rioja –particularly in the earing act-, and to ensure inclusive and effective access to justice for persons with disabilities according to the Convention on the Rights of Persons with Disabilities, the 100th Rules of Brasilia for the access of justice of vulnerable persons, the Protocol of Access of Justice for Persons with disabilities, National Constitution, Civil y Commercial National Code. We use juridical dogmatic and documental recompilation techniques. We study leading cases of Inter-American Court of Human Rights, Supreme Court of Justice of Argentina and Supreme Court of Justice of La Rioja.
