El error sobre los presupuestos de las causas de justificación.

Abstract

En el presente trabajo se pretende examinar cual ha sido el tratamiento asignado al error sobre los presupuestos de las causas por las distintas corrientes dogmáticas y/o sistemas de imputación y cuales han sido las razones para ello. Asimismo, se intenta examinar si las razones han sido exclusivamente dogmáticas vinculadas al texto legal y/o con el sistema de imputación elegido, y/o si en su tratamiento se han privilegiado las consecuencias político-criminales y/o de justicia material que acarrea la adopción de una u otra solución.

Abstract

This word seeks to examine what has been the treatment of the error on the budgets of the various currents causes dogmatic and / or imputation systems which have been the reasons for it. Likewise, attempts to examine whether the reasons have been exclusively linked to dogmatic legal text and / or the chosen imputation system, and / or its treatment have been privileged political consequences and / or criminal justice that brings the material adoption of one or another solution.
