El concepto jurídico – penal de culpabilidad y su evolución dogmática

Abstract

El presente trabajo consiste en un breve análisis sobre la evolución dogmática del concepto de culpabilidad como categoría dentro de la Teoría General del Delito. En tal sentido, la culpabilidad -presupuesto imprescindible a los fines de la aplicación de una pena- ha ido mutando y desarrollándose, siendo analizada aquí desde las perspectivas de la concepción psicológica, la concepción normativa, la “puramente normativa” del finalismo y las funcionalistas de Claus Roxin y de Günter Jakobs.

Abstract

This work consists of a brief analysis on the dogmatic evolution of the concept of culpability as a category inside the General Theory of Crime. To this respect, the culpability -indispensable budget to apply a punishment- has been mutating and developing, being analyzed here from the perspectives of the psychological conception, the normative conception, the "purely normative " conception of the finalism and the functionalists of Claus Roxin and Günter Jakobs.
