Filiación por técnicas de reproducción humana asistida. Aplicación del Código Civil y Comercial de la Nación.

Abstract

Las técnicas de reproducción humana asistida han tenido un importante desarrollo en los últimos cuarenta años, impactando en la realidad de las parejas con dificultades para procrear. Por tal motivo, las innovaciones biomédicas debían ser reguladas. El Código Civil y Comercial de la Nación las ha tomado en cuenta, incluyéndolas como nueva fuente de filiación. Dada la relevancia del tema, su impacto social y sus proyecciones sobre otras instituciones jurídicas, la nueva legislación cuenta con una norma temporaria que permite la aplicación de su regulación a las situaciones jurídicas preexistentes.

Abstract

The assisted human reproduction techniques have had an important development in the last forty years, impacting on the reality of couples with difficulties to procreate. For this reason, these biomedical innovations must be regulated. The Civil and Commercial Code of the Nation has taken them into account by including them as a new source of filiation. Given the relevance of the topic, its social impact and their projections on other legal institutions, the new legislation has a temporary rule that allows the application of the law to the pre-existing legal situations.
