Resumen

Para la legislación argentina, actualmente, no existe una definición legal de ―contrato agrario‖, como tampoco un Código Agrario, ni una Ley General de estos contratos que pueda contribuir a dilucidar los puntos oscuros de esta materia. Con el vacío en la legislación de fondo, la materia tributaria no se ha preocupado demasiado por una regulación específica.A través de un método descriptivo, se pretende exponer de manera ordenada, clara y precisa, el tratamiento impositivo a dispensar en los principales impuestos nacionales de los contratos más comúnmente utilizados en la práctica, con el objeto de disminuir algunos interrogantes, la confusión que generan las distintas interpretaciones, y con ello la consecuente inseguridad jurídica para las partes.AbstractIn the current Argentine legislation system there is not a legal definition of "agrarian contract", an Agrarian Code or any kind of General Law regarding these contracts, which could help to contribute to the clarification of the uncertainties concerning this matter. As a result of a legal vacuum regarding substantive law, it can be said that tax law has not really taken charge of imposing a specific regulation. It is expected to explain through a descriptive method the tax treatment that is going to be applied in the main national taxes of the most common used contracts in a clear and accurate way with the goal of addressing some unanswered questions, clearing up the confusion arising from different interpretations and consequently, reducing the legal uncertainty existing between the parties.Key Words: Contracts; Agriculture and livestock; Taxation; Lease; Rural; Income tax; Estimated minimum income tax; Personal property; Value Added Tax
